General terms and conditions of UMSITEC environmental and safety engineering

§ 1. Scope

The following terms and conditions apply to all electronic, phone, fax or e-mail via the Internet portal www.UMSITEC-SHOP.de transmitted orders and be recognized for all orders with you. Referring to the terms and conditions of the customer is expressly contradicted.

§ 2. Sales only to professionals

Because of legal restrictions, we cannot supply private persons in our online shop.
Consequently, we offer our goods exclusively to commercial purchasers.

§ 3. Conclusion

All offers of UMSITEC to - www.UMSITEC-SHOP.de - are non-binding invitation for the customer to order UMSITEC products, services, or similar.
By ordering the requested quotation made to the Internet via e-mail, fax or telephone, the customer makes a binding intent to conclude a sales contract.
The intent is binding, unless the order of the respective interface to UMSITEC has passed.
UMSITEC is entitled to accept this offer within a period of max. five working days by sending an order confirmation.
The order confirmation shall be sent by e-mail or fax. After this period without confirming the order is not accepted.
All deliveries and services are subject to these terms and conditions.

§ 4. Prices

There are at the time of the order to -www.UMSITEC SHOP.de- listed prices. All prices are pickup prices from stock - Heerweg 15 D, D-73770 Denkendorf - including VAT and plus shipping costs.
For commercial customers for information purposes, the amounts of net value of goods added VAT are specified.
Please note that prices and availability and delivery times of products in -www.UMSITEC-SHOP.de- may differ from other offerings in UMSITEC.

§ 5. Order

All orders received over the weekend, will be at night and on holidays usually processed on the next business day. From  processing day, starts all contractually agreed dates.
UMSITEC reserves the right for incoming orders to commission a credit check, which may possibly lead to a delay.

§ 6. Right of Revocation

As a consumer according to § 13 BGB, you can revoke your contract explanation within two weeks without giving reasons in writing (e.g. letter, fax, e-mail) or by returning the goods. The period begins with receipt of this notice.

 For keeping of the revocation period it is sufficient to send the revocation or things in time.

Consequences:
In the case of an effective withdrawal, the mutually received benefits and any benefits (e.g. interest) are surrendered.
Can you give us the received achievement totally or partly or only in deteriorated condition, you must pay us compensation for the value.
With the release of things this does not apply if the deterioration is exclusively on their check, as they would in a retail store, is due.
In addition, you can avoid paying compensation by not using the goods as your property and omitting everything, which impairs their value.

Transportable merchandise are to be returned. You have to bear the cost of return shipment if the ordered goods are delivered and if the price of the returned goods not exceeding the amount 40 Euros or at a higher price at the time of revocation the concideration or a contractually agreed part payment has not been provided. Otherwise, the return is free for you.

Parcels, not able to dispatch will be collected by costumer.
Obligations to reimburse payments must be made within 30 days after sending your revocation.

A right of revocation does not exist in the following cases:

   in the supply of goods which were manufactured according to customer specifications or clearly tailored to
   personal needs of the clients or are not suitable due to their condition for a return.

§ 7. Delivery

If delivery is agreed separately, this product will be delivered from the warehouse to the address given by the customer. Should not all ordered goods in stock, we reserve the right to partial deliveries from as far as this is economically reasonable for the contractor.
Delivery will be made against a packaging and delivery charge, the exact amount for each delivery is separately stated. Generally, the delivery takes place solely in Germany.
The delivery and / or installation of goods is already in the ordering process to be agreed separately at extra cost.

§ 8. Delivery time

Our service includes, of course, a quick, uncomplicated delivery. Stock will be shipped within 24 hours, with repeat orders this is usually after 14 days.

§ 9. Reservation of Delivery

UMSITEC is entitled to rescind the contract, so far, despite the prior conclusion of a corresponding purchase contract on her part the object of delivery not receives.
We are committed at the same time, immediately notify the non-availability to reimburse compensation to the contractor immediately and find an alternative product.

§ 10. Payment

UMSITEC offers the option of paying by cash on delivery (fee 5,00 €), by calling in advance for confirmation of order or by credit cards. UMSITEC reserves the right, for deliveries to existing customers to deliver by invoice or direct debit. This requires a written approval by UMSITEC.

§ 11. Retention of title

All goods delivered remain the property of UMSITEC until full payment.
The retention of title extends also to processed objects in the case of resale in the amount of the invoice, resulting from the legal relationship between the conditional seller and conditonal buyer.

§ 12. Warranty

If items have obvious material or manufacturing defects, please complain about such errors within two weeks versus UMSITEC.
In case of obvious, external damage, we ask you to confirm immediately this by the staff of the shipping company on the shipping documents and notified UMSITEC within 14 days.
For all defects to the merchandise at each time of purchase, warranty period and warranty rights are valid.

§ 13. Privacy Policy

The data necessary for processing the transaction data is stored. This notice is in accordance with the reulations of the Federal Privacy Act and the Teleservices Data Protction Act.
All personal data is treated confidentially.

§ 14. Place of jurisdiction, place of fulfilment, applicable law

Place of fulfilment and exclusive place of jurisdiction for merchants, legal persons of public law and public law special fund for all of the contractual relationship between the parties and arising disputes is UMSITEC Kirchheim unter Teck or Stuttgart. It is only the German law excluding the UN sales law.

§ 15. Severability

If any of these regulations be invalid, the validity of the remaining regulations shall not be affected.
